Village Green
Our village green policies are offered on a post-planning basis once we have had the opportunity to review the planning objections, and assuming we are comfortable with these. Before we can provide cover we also want to know a bit about the history of the site from the current owners, details of any fencing/signs that may defeat a claim for village green rights and evidence of what rights (if any) are currently being enjoyed over the site. We will carry out limited title investigations in the surrounding area to ascertain whether any properties have been in situ for 20 + years. If the area around the site has only been developed in recent years it will make it harder for anyone to produce evidence necessary to satisfy the statutory requirements.
What we require
The information that we require in order to quote is:
- A plan identifying the land to be developed.
- Background information on the following:
- A history of the site and its previous uses.
- Evidence to rebut grounds for an application to register the land as village green by reference to the criteria in section 15 Commons Act 2006, e.g. any fencing or signage around the site; details of the current use by the legal owner permitting use of the land.
- Photographs of the land detailing current state and boundaries.
